Terms of Service
Terms of Service of the Aion Labs API.
Version 2026-10-17, effective from 17 October 2026. Also available in Polish.
1. Who we are
These Terms of Service ("Terms") govern the services offered under the Aion Labs brand by:
Deep Forge sp. z o.o.
Sąd Rejonowy dla m.st. Warszawy w Warszawie, XIV Wydział Gospodarczy KRS, KRS 0001036658

("Aion Labs", "we", "us"). You can reach us at [email protected].
2. Definitions
- "Service" — the Aion Labs API for sending requests to large language models, the account dashboard at aionlabs.ai, and — where made available to you under section 5 — the Email Agents.
- "Email Agents" — AI agents that carry out tasks and handle email on your behalf, acting in your name.
- "Account" — the account you create at aionlabs.ai in order to use the Service.
- "Credits" — the prepaid balance on your Account, in US dollars, consumed as you use the Service.
- "Models" — the AI models available through the Service, listed with their prices and limits on the Models page.
- "Input" — everything you send to the Service; "Output" — the content a Model generates in response.
- "Consumer" — a natural person using the Service for purposes unrelated to their trade or profession, including a sole trader where the contract is not of a professional character for them. "Business Customer" — any other customer.
Nothing in these Terms limits the rights Consumers have under mandatory law. Where a provision is less favourable to a Consumer than that law, the law applies instead.
3. Your Account
You create an Account by registering on our website or by signing in with a supported identity provider, and accepting these Terms. You must be at least 18 years old. You may hold one Account; if your organisation needs shared access, contact us. If you use the Service on behalf of a company or other organisation, you confirm that you are authorised to bind it to these Terms. Using the Service requires an internet connection and a current web browser; using the API requires software able to make HTTPS requests.
You are responsible for keeping your password and API keys confidential and for the requests made with them. You can revoke API keys in the dashboard at any time; tell us without delay if you suspect a key or password has been compromised. You are not liable for use of your Account after you have notified us, unless you caused it.
4. Using the Service
You may use the Service for any lawful purpose, including commercially — building products on the API, serving your own users and reselling access as part of a product of your own. You may not resell raw access to our API or your API keys as a standalone product. Each Account has rate limits that depend on its tier, as described on the Rate Limits page; free use before any purchase is a courtesy that we may change or withdraw at any time.
You may not use the Service, or allow others to use it through you, to:
- generate or process material that sexualises minors in any form, including fictional depictions;
- facilitate human trafficking, terrorism, violent extremism or political violence;
- produce content that incites hatred or violence against people because of a protected characteristic, or that harasses, intimidates or threatens a specific person;
- encourage or instruct self-harm or suicide;
- infringe third-party rights, including intellectual property and privacy;
- create or spread malware, attack our or anyone else's systems, or try to bypass our security, limits or billing;
- mislead people into believing they are interacting with a human where the law requires disclosure, or otherwise break the law applicable to you or your end users.
If you make Outputs available to other people, you are responsible for complying with the obligations that apply to you towards them, including under the EU AI Act, and for the terms you agree with your own users.
5. Email Agents
Email Agents are made available by individual arrangement, which states the price and any limits. An Email Agent acts on your instructions and in your name: you are responsible for the instructions you give it, for reviewing its behaviour, and for every email it sends on your behalf as if you had sent it yourself. You must have the right to let us process the data you route to it, and you must tell your correspondents that they are dealing with an AI agent where the law requires it. Everything in these Terms about Input, Output and prohibited use applies to Email Agents too.
6. Input, Output and intellectual property
You retain all rights to your Input. You grant us the right to process it only as needed to provide the Service. We do not use your Input or Output to train models and we do not sell them. You confirm that you have the rights needed to submit your Input.
To the extent we hold any rights in Output, we assign them to you on generation. Output is generated statistically: it may be inaccurate, incomplete or similar to Output generated for other customers, and may in rare cases reproduce third-party material. You are responsible for checking Output before relying on it or publishing it; it is not professional advice.
The Service, our website, documentation, trademarks and software remain our property or that of our licensors. Nothing in these Terms gives you any rights in the Models beyond using them through the Service.
Where your Input contains personal data of other people, you are the controller of that data and we process it on your behalf. Business Customers who need a data processing agreement can request one at [email protected]. How we process your own personal data is described in our Privacy Policy.
7. Availability and changes to Models
We aim to keep the Service available continuously but do not guarantee uninterrupted operation; we carry out maintenance and outages can occur. Consumers keep their statutory remedies where the Service does not conform to the contract.
The set of Models and their prices change over time. We may add Models at any time and may retire a Model or reduce its limits with at least 14 days' notice on the Models page where we are able to give it. Price changes apply only to future usage and never reduce the value of Credits you already hold.
8. Credits and payment
Usage is priced per Model, in US dollars, as shown on the Models page at the time of the request. You buy Credits in the dashboard; the total price including any VAT is shown before you confirm, and Credits equal to the net price (excluding VAT or sales tax) are added once the payment is confirmed. Card purchases are processed by our payment provider, which acts as the seller of record for the payment transaction and issues the receipt or invoice; its payment terms apply to that transaction alongside these Terms. Credits are a prepayment for the Service, not electronic money, and cannot be transferred to another Account. Purchased Credits do not expire for as long as your Account exists. Promotional Credits may carry an expiry date and are not refundable.
Prepaid Accounts stop serving requests when the balance reaches zero. Automatic top-ups, invoicing and other arrangements for Business Customers are agreed individually and governed by these Terms unless the arrangement says otherwise; we may suspend the Service for an overdue invoice after a reminder.
If you believe you were charged incorrectly, tell us as soon as you can — Business Customers within 60 days of the charge — and we will investigate and correct any error; this does not limit the statutory rights of Consumers. Refunds under these Terms are made within 14 days using the original payment method where possible. A chargeback raised for a charge that was correct under these Terms is treated as a complaint; we may suspend the Account while it is pending.
If an Account has not been used for 24 months we may close it after notifying you by email; remaining purchased Credits are then refunded. Credits are never forfeited for inactivity alone.
9. Right of withdrawal (Consumers)
As a Consumer you may withdraw from the Account contract and from any purchase of Credits within 14 days, without giving a reason, by sending us a clear statement (an email to [email protected] is enough; you may also use our model withdrawal form). Because Credits are available immediately, by using them within the 14 days you ask us to start performing the service during the withdrawal period; if you then withdraw, you pay for the usage up to that moment and we refund the rest within 14 days. You do not lose the right of withdrawal by using the Service.
10. Liability
Towards Consumers we are liable under the generally applicable law. Towards Business Customers our total liability in any 12-month period is limited to the amount paid to us in that period and excludes lost profits, lost data and other indirect damage; statutory warranty is excluded. Nothing in these Terms limits liability for intentional misconduct, gross negligence, death or personal injury, or where such a limitation is prohibited by law. We do not vouch for the accuracy or fitness of Output, and you are responsible for how you and your end users use it.
11. Termination
You may delete your Account at any time in the dashboard or by emailing us; the contract ends on deletion and we refund remaining purchased Credits to Consumers within 14 days. Business Customers may request such a refund within 30 days, unless the Account was closed for a breach of section 4.
We may terminate the Account contract with 14 days' notice, stating the reason, where we discontinue the Service, where you breach these Terms and do not remedy the breach after a warning, where you are in arrears under an invoicing arrangement, or where the law requires it. Business Customers may additionally be given 30 days' notice without a reason. We may suspend an Account without prior notice only to stop a serious ongoing breach — prohibited content, attacks on our systems or third parties, payment fraud or a lawful order; we tell you the reason promptly and you may respond.
After the contract ends we delete the Account's data as described in the Privacy Policy, except records we must retain by law. Sections 6, 10, 13 and 14 continue to apply to matters that arose before termination.
12. Changes to these Terms
We may change these Terms for important reasons: a change in the law, a decision of a court or authority, changes to the Service's features, Models, prices or technical conditions, security needs, or correction of errors. We announce changes at least 14 days before they take effect by email to your Account address and on our website. If you do not accept a change, you may terminate the contract free of charge before it takes effect by deleting your Account, with the refund described in section 11. Changes solely to your advantage or purely editorial may take effect immediately. Where a change to the Service itself has more than a minor negative impact on a Consumer, the Consumer may terminate free of charge within 30 days of being notified.
13. Complaints and disputes
Send complaints about the Service, billing or these Terms to [email protected]. We respond within 14 days; if we do not respond to a Consumer's complaint within that time, it is deemed accepted. Consumers may also use out-of-court dispute resolution, including mediation or arbitration through the Trade Inspection and free help from a consumer ombudsman — see uokik.gov.pl.
These Terms are governed by Polish law; Consumers keep the protection of the mandatory law of their country of residence. Disputes with Consumers are heard by the courts having jurisdiction under general rules; disputes with Business Customers by the Polish court for our registered seat.
14. Final provisions
We communicate with you by email to your Account address and through the dashboard. We may transfer the contract to a legal successor or an entity taking over the Service with 14 days' notice, during which you may terminate free of charge; you may transfer your Account only with our consent. If any provision is found invalid, the remaining provisions stay in force. The contract consists of these Terms, the order details confirmed at checkout and any individual arrangement with a Business Customer. The Terms are published in Polish and English; if the two texts differ, the Polish text prevails. Every version of the Terms is available on our website at its own address; for Accounts created before 17 October 2026, these Terms replace the previous version on that date under section 12.
